City Commission Meeting <br />June 23, 2003 <br />Page 9 <br /> <br />Commissioner Al Clark suggested modifications to Section 11 as follows: <br /> <br />11 (a) For clarification, add "If grantor does give such notice to purchase, this franchise <br /> agreement will be extended as long as the pumhase process continues." <br /> <br />11 (k) Add sentence, "The 180 days may be extended if there are unforseen acts out of the <br /> control of the Grantor." <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Ordinance 03-1086, <br />Franchise Agreement with Progress Energy, be approved on first reading with <br />modifications as outlined, The motion was seconded by Commissioner Susan <br />Doerner and motion carried on a 3 - 2 roll call vote. Commissioner Linda <br />Hart and Mayor Bruce Pronovost dissenting. <br /> <br />The public hearing for Ordinance 03-1086 will be scheduled for July 28, 2003. <br /> <br />5. 3. Discussion Regarding Various Referendum Options/Electric Franchise Issue <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that the City Attorney be <br />directed to develop language for a referendum on the electric issue. The <br />motion was seconded by Commissioner Linda Hart and carried on a 3 - 2 roll <br />call vote. Commissioners Susan Doerner and Kathy Cook dissenting. <br /> <br />The City Attorney will draft language for a referendum question for consideration by the Commission at their <br />meeting of July 14, 2003. <br /> <br />A verbatim transcript of the discussion regarding various referendum options/electric franchise issue is <br />attached to and made a part of these minutes. <br /> <br />6. First Reading of Ordinance 03-1089 Annexation of Leonard Casselberry Belle Avenue Property <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner A! Clark that Ordinance 03-1089, Belle <br />Avenue Annexation, be read by title only. The motion was seconded by <br />Commissioner Susan Doerner and carried unanimously by voice vote. <br /> <br />The City Clerk mad ordinance 03-1089 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF <br />CASSELBERRY, FLORIDA, CERTAIN LANDS LOCATED IN SECTION 4, <br />TOWNSHIP 21S, RANGE 30E; REDEFINING THE CORPORATE LIMITS OF THE <br />CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM <br />PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT <br />CERTAIN COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR <br />PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO <br /> <br /> <br />
