CASSELBERRY CITY COMMISSION Minutes of Februar,j 10, 2003 - Regutar Meeting Page 2 of I I PUBLIC HEARING SECOND READING OF ORDINANCE 03-1078 - AMENDING THE CITY UNIFIED LAND DEVELOPMENT REGULATIONS REVISING PMX-L AND PMX-H ZONING DISTRICTS MOTION: Vice Mayor Clark moved to read Ordinance 03-1078 by title only. Motion was seconded by Commissioner Doerner. Motion carried unanimously by voice vote. The City Clerk read Ordinance 03-1078 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY, FLORIDA, UNIFIED LAND DEVELOPMENT REGULATIONS TABLE 2-5.3, LAND USE BY DISTRICT, AS ESTABLISHED IN ARTICLE V, SECTION 2-5.2, AS AMENDED AND SUPPLEMENTED; ALLOWING AS A CONDITIONAL USE VEHICULAR SERVICES, MAINTENANCE AND LIGHT MECHANICAL REPAIRS IN THE PMX-H ZONING DISTRICT; CREATING SECTION 2-7.27 VEHICULAR SERVICES, MAINTENANCE, AND LIGHT MECHANICAL REPAIR IN THE PMX-H AND PMX-L ZONING DISTRICTS; ESTABLISHING DESIGN CRITERIA TO REDUCE NEGATIVE IMPACTS; PROVIDING FOR CONFLICTS, SEVERABILITY, COD~ICATION AND AN EFFECTIVE DATE." The Notice of Public Hearing relative to Ordinance 03-1078 was published in the Orlando Sentinel on January 30, 2003. Ordinance 03-1078 was passed on first reading on January 13, 2003. Ms. Smith stated Ordinance 03-1078 provides for allowance of vehicular services, maintenance and light mechanical repair as a conditional use in the PMX-H and PMX-L zoning districts when the subject use is properly buffered from residential uses. Ordinance 03-1078 also provides for design considerations to mitigate potential negative impacts of vehicular services. The Planning & Zoning Commission/Land Planning Agency voted 5-0 at its December 1 I, 2002 meeting to recommend approval of Ordinance 03 - 1078. Ms. Smith noted the following scrivener's error on page 2 of Ordinance 03-1078: Section II - change numbering of items (9) through (16) to (1) through (8). Staff recommended approval of Ordinance 03-1078 on second reaffIng as corrected. Mayor Pronovost asked if there was anyone in the audience that wished to speak either for or against Ordinance 03-1078. No one came forward. Mayor Pronovost closed the public hearing. MOTION: Vice Mayor Clark moved to approve and adopt Ordinance 03-1078 on second and final reading, as corrected. Motion was seconded by Commissioner Doerner. Motion carried unanimously by roll call vote.
