RESOLUTION 14-2673 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING SUPPLEMENTAL AGREEMENT NO. 1 TO THE STATE HIGHWAY MAINTENANCE MEMORANDUM OF AGREEMENT (MOA) BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, for nearly 15 years, the City has received compensation from the Florida Department of Transportation (FDOT) for maintaining the beautification and routine right-of-way maintenance elements of U.S. Highway 17-92 and S.R. 436; and WHEREAS, on November 13, 2012 via Resolution 12-2432, the City Commission approved the renewal of State Highway Maintenance Memorandum of Agreement (MOA) with FDOT (Contract# APT00) that provided compensation to the City for continuing to maintain the right-of-ways on the aforesaid roadways; and WHEREAS, FDOT has submitted Supplemental Agreement No. 1 to the current MOA that will provide an additional $20,844 of compensation to the City for area maintenance of right-of- ways on S.R. 436 from Howell Branch Road to the southern end of the City limits for an adjusted total amount of $90,844.00 until April 30, 2016; and WHEREAS, Public Works staff has reviewed the proposed Supplemental Agreement No. 1 to the State Highway Maintenance MOA with FDOT and finds it favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Supplemental Agreement No. 1 to the State Highway Maintenance Memorandum of Agreement between the Florida Department of Transportation and the City of Casselberry, District Contract Job Number APT00-R1, State Job Number 244549-1-78-01, for an additional compensation amount of $20,844, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. The City Commission hereby accepts the terms and conditions as presented in said Agreement. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
