<br />MONITORING WELL EASEMENT
<br />THIS MONITORING WELL EASEMENT is made and entered into this 5 1!� day of
<br />/ ecok btu , 20-1-5,1--, by and between the CITY OF CASSELBERRY, whose address is 95
<br />Triplet Lake Drive, Casselberry, Florida 32707, hereinafter referred to as "GRANTOR", and
<br />SEMINOLE COUNTY, a political subdivision o the State of Florida, whose address is 1101
<br />East First Street, Sanford, Florida 32771, hereinafter referred to as "GRANTEE".
<br />WITNESSETH:
<br />GRANTOR, by these presents does hereby grant and convey unto GRANTEE and its
<br />successors a perpetual easement for the installation, operation and maintenance of a monitoring
<br />well and appurtenances (the "Easement") with full authority to enter upon said Easement and
<br />locate, excavate, construct, install, operate, maintain, repair and remove a monitoring well and
<br />all appurtenances thereto over, under, upon and through the following described and depicted
<br />property (the "Premises") situate, lying and being in Seminole County, Florida, to wit:
<br />See Exhibit A, attached hereto and incorporated herein by reference.

<br />GRANTEE and its successors shall not unduly disturb the Premises, but have the right to
<br />locate, excavate, construct, install, operate, maintain, repair or remove said monitoring well and
<br />all appurtenances thereto, including the rights and privileges reasonably necessary and
<br />convenient for the use and purpose of providing hydrologic monitoring of adjacent or nearby
<br />wetland areas and further right to trim, cut and remove saplings (but not large trees), bushes,
<br />undergrowth and other obstructions interfering with the location, excavation, construction,
<br />installation, operation, maintenance, repair and removal of said monitoring well and
<br />appurtenances thereto.
<br />GRANTOR further agrees not to build or create, or permit others to build, construct or
<br />create any building or other structure on the Premises that may interfere with the location,
