CASSELBERRY CITY COMMISSION <br />Minutes of March 24, 2025 — Regular Meeting <br />Page 7 of 14 <br />Recommendation: The City Manager and the City Clerk recommended adoption of Ordinance 25-1618 <br />on second and final reading. <br />Public Hearing: Vice Mayor Busch stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1618. Vice Mayor Busch opened the floor for public participation. No <br />one came forward to address Ordinance 24-1618. Vice Mayor Busch closed the public hearing relative to <br />Ordinance 24-1618. <br />MOTION: Commissioner Kirk moved to adopt Ordinance 24-1618 on second and final <br />reading, as presented. Motion was seconded by Commissioner Divita. <br />Motion carried unanimously by voice vote 3-0. <br />B. Public Hearing: Second Reading of Ordinance 24-1619 — Amending ULDR Article <br />XVI, Signs, to Allow Electronic Messaging Centers (EMCs) and Provide for <br />Performance Standards <br />The City Clerk read Ordinance 24-1619 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, ADDING A NEW SECTION <br />RELATING TO ELECTRONIC MESSAGE CENTERS (EMC); AMENDING ARTICLE XVI, <br />"SIGNS" OF CHAPTER III, "PERFORMANCE CRITERIA", PART HI, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, OF THE CITY OF CASSELBERRY CODE OF <br />ORDINANCES BY AMENDING SECTION 3-16.2, "DEFINITIONS"; SECTION 3-16.3 "ON - <br />PREMISES PERMANENT SIGN REGULATIONS"; SECTION 3-16.6 "RESERVED"; AND <br />SECTION 3-16.8, "PROHIBITED SIGNS" TO ALLOW ELECTRONIC MESSAGE CENTERS <br />UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to second reading of Ordinance 25-1618 <br />was advertised in the Orlando Sentinel on Thursday, March 13, 2025. <br />Business Impact Statement: A Business Impact Statement was provided for this ordinance in accordance <br />with Section l 66.041(4), Florida Statutes. <br />Staff Presentation: Chief Planner Antonia DeJesus presented photographs of Electronic Messaging <br />Centers from other jurisdictions, showing examples that both contrasted and aligned with the standards <br />being proposed, as requested by Commissioner Kirk at the first reading of the ordinance. She then gave an <br />overview of Ordinance 25-1619, which amends Article XVI, Signs, of the City's Unified Land <br />Development Regulations (ULDR) to permit the installation of Electronic Messaging Centers (EMCs) in <br />specific zoning districts and provide for performance standards. The proposed ordinance consists of four <br />key changes. The first change would amend ULDR Section 3-16.2. Definitions. to include "Electronic <br />Message Centers", defined as "An on -premises ground sign component without moving parts that utilizes <br />a computer or other electronic means to change the digital message displayed through the use of intermittent <br />light or lights, including light emitting diodes, liquid crystal display, plasma image screen display, or similar <br />equipment." The second change would amend ULDR Section 3-16.3. On -premises permanent sign <br />regulations. to list electronic messaging centers as a permissible sign type. EMCs are proposed to be <br />
