specifically enforceable written agreement. This modified stipulated agreement <br />consummates the contemplated future administrative actions on the part of the CITY. <br />Upon approval of this Modified Stipulation and Settlement Agreement and payment of <br />the $37,500.00 by the CITY, DECKER shall file a notice of voluntary dismissal to <br />dismiss this action with prejudice. <br />2. The legal description for DECKER's Property is as follows: <br />The North 191.66 feet of Block "B" (less the West 450.00 feet of said Block "B") <br />Normandy Addition to Casselberry, Florida, Plat Book 7, Pages 49 & 50, <br />Seminole County, Florida. <br />Block "C" (less the West 436.00 feet of the North 200.00 feet of said Block "C" <br />and also less the West 450.00 feet of the South 191.66 feet of said Block "C") <br />Normandy Addition to Casselberry, Florida, Plat Book 7, Pages 49 & 50, <br />Seminole County, Florida. <br />3. The CITY has prepared and filed an application for the necessary permits <br />with the DISTRICT for its drainage system adjacent to DECKER's Property to provide <br />for a stormwater pipe with sufficient capacity to accommodate stormwater at a rate <br />equivalent to the pre -development rate that would have gone into the drainage well, <br />including the discharge from the CITY's existing pond. This pipe will run from the <br />CITY's existing pond south to grassy lake (the "outfall pipe"). The outfall pipe will <br />redirect stormwater flows from the CITY's existing pond and the roads and adjoining <br />private property lying east of DECKER's Property as depicted on Exhibit "A" attached to <br />and incorporated in this stipulation such that the said pond and property shall not <br />Modified Stipulation of Settlement <br />Decker v.
