RESOLUTION 11-2239 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA AUTHORIZING THE EXECUTION OF AN AMENDED LOCAL AGENCY PROGRAM AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF TRANSPORTATION AND THE CITY OF CASSELBERRY FOR THE WIRZ TRAIL SECTION 1 PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, on January 24, 2011, via Resolution 11-2223, the City Commission approved a Local Agency Program (LAP) Agreement with the Florida Department of Transportation (FDOT) for obtaining and providing financial reimbursement assistance to the City for construction costs of Wirz Trail Section 1 in the amount of $1,312,014; and WHEREAS, FDOT has notified the City of Casselberry that a City match of funds is required in the amount of $27,856.00; and WHEREAS, FDOT has submitted an amended LAP Agreement for the Wirz Trail Section 1 project which provides for the construction and CEI reimbursement costs of $1,284,158.00; and WHEREAS, the FDOT has requested that the City of Casselberry execute and deliver the amended LAP Agreement #FPN 417461-1-58-01 to the Florida Department of Transportation for funding of the aforementioned project. in the amount $1,284,158.00 with a required City match of $27,856.00, for a project total of $1,312,014.00; and WHEREAS, Public Works Department staff has reviewed the amended LAP Agreement between the City of Casselberry and FDOT and finds it favorable to the City NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the amended Local Agency Program agreement #FPN 417461-1-58-0 (attached as Exhibit A) with the Florida Department of Transportation for construction of Wirz Trail Section 1 and authorizes the Mayor to execute said document on behalf of the City SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
