REPRESENTATION AGREEMENT BETWEEN KOSTO & ROTELLA, P.A. <br />AND CITY OF CASSELBERRY <br />THIS AGREEMENT entered into with the effective date of July 15, 2011, by and between <br />KOSTO & ROTELLA. P.A., 619 East Washington Street, Post Office Box 113, Orlando, Florida <br />32801 and CITY OF CASSELBERRY, (hereinafter "client"), 95 Triplet Lake Drive, Casselberry, <br />Florida 32707. <br />DEFINITIONS <br />A. A Claim. A claim is an amount owed to the City of Casselberry due to code <br />enforcement action which arises from any administrative fine, costs of repair, liens, etc. or other <br />obligation submitted to Kosto & Rotella, P.A. (hereinafter known as AK&R@) , to attempt to collect. <br />B. A Commission. A commission is the compensation payable by the City of <br />Casselberry to K&R and earned by K&R for their services in effecting collection of a claim, whether <br />directly, indirectly or otherwise, in whole or in part, and is contingent and computed as a percentage <br />of the sums collected. <br />C. A Non -Contingent Suit Fee. A suit fee is a non-refundable fee payable to a law firm, <br />in addition to the commission, for legal services rendered by the law firm for the client paid to K&R <br />for their representation in any new or existing lawsuit, litigation, domestication of foreign judgment <br />and post judgment collection. <br />D. Cost Deposit. A cost deposit is the sum of money advanced by client to K&R, as a <br />fund from which court costs or sums required to be paid to a third party for related litigation costs are <br />to be expended pre or post Judgment. <br />E. Counterclaim. A Counterclaim is a lawsuit filed by a Debtor against client where the <br />Debtor seeks to recover a Judgment against client. <br />F. Deposition in aid of Execution. This is a post -Judgment deposition conducted to <br />locate assets to proceed against to collect a Judgment. K&R will conduct such a deposition at a flat <br />fee, if client agrees to pay the costs to proceed with such deposition in aid of execution. <br />NOW THEREFORE, for valuable consideration, the sufficiency of which is hereby <br />acknowledged, the parties stipulate and agree as follows: <br />1.
