<br />PERPETUAL UTILITY EASEMENT
<br />THIS INDENTURE, made this 20 day of October, A.D. 2011, by and between AIM ORLANDO
<br />SCHOOL BUILDING, LLC, a Virginia Limited Liability Company, GRANTOR, having a post office address of
<br />4455 South Blvd., Suite 500, Virginia Beach, VA 23452 and the CITY OF CASSELBERRY, FLORIDA, a
<br />municipal corporation, GRANTEE, having a post office address of 95 Lake Triplet Drive, Casselberry,
<br />Florida, 32707.
<br />WITNESSETH, for and in consideration of the sum of Ten Dollars ($10.00) together with other
<br />good and valuable consideration paid by the GRANTEE to the GRANTOR, the receipt of which is hereby
<br />acknowledged, GRANTOR , by these presents, does hereby give, grant, bargain, and sell unto the
<br />GRANTEE and its successors and assigns, a utility easement and right of way, including the perpetual
<br />right to enter upon said easement at anytime that it may see fit, and construct, lay, reconstruct,
<br />operate, maintain, and install utility lines, fixtures, accessories, and all appurtenances thereto, for the
<br />purpose of operating and maintaining utilities under, upon and across the following described property,
<br />lying and being in Seminole County, to wit:
<br />Commence at the southwest corner of Lot 5, Lake Kathryn Terrace, as recorded in Plat
<br />Book 10, Page 55 of the Public Records of Seminole County Florida; thence run N 15° 19'
<br />00" E along the east right-of-way line of U.S. Highway 17 / 92 a distance of 512.73 feet
<br />to the point of beginning of a 15.00 foot wide Perpetual Utility Easement lying 7.50 feet
<br />contiguously on each side of the following described centerline; then departing said east
<br />right-of-way line run S 74° 35' 50: E, a distance of 124.21 feet; thence run N 49° 18' 50"
<br />E a distance of 34.88 feet to the point of termination of this description.

<br />The GRANTEE shall have the right to excavate, patrol, inspect, alter, improve, repair, rebuild, or
<br />remove such utility lines, equipment, and accessories, including the right to increase or decrease the
<br />number of same, together with all rights and privileges reasonably necessary or convenient for the
<br />enjoyment or use thereof for the purposes above described. GRANTEE shall also have the right to trim,
<br />cut, and keep clear such trees, roots, limbs, and undergrowth along said utility lines, and all trees
