Davis, whose address is 1201 Lancelot Way, Casselberry, Florida 32707, hereinafter referred to as the "Owner". WITNESSETH: WHEREAS, the Owner owns certain real property, hereinafter referred to as the "Property," situated in Seminole County, Florida, described as Lot 3, Block A, Camelot Unit 3; as recorded in Plat Book 20, pages 88/89; and WHEREAS, the rear seven and a half (7.5) feet and the east side five (5) feet of the Property are designated on the plat recorded in Plat Book 20, Pages 88/89 in the Public Records of Seminole County, Florida, as an easement, which area is hereinafter referred to as the "Easement Area,"; and WHEREAS, the Owner, or his predecessor in title, constructed a shed on the Property which was permitted by the City and which encroaches upon the Easement Area, and the Owner now desires to replace the shed; and WHEREAS, the Property is very constrained and there is no other possible location for the shed than in the Easement Area; and WHEREAS, the parties hereto wish to enter into this Encroachment Agreement to allow the shed to encroach into the Easement Area. 1
