RESOLUTION 13-2473 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF THE INTERLOCAL AGREEMENT FOR THE SHARED DISTRIBUTION OF THE SIX CENT LOCAL OPTION MOTOR FUEL AND DIESEL FUEL TAX BETWEEN SEMINOLE COUNTY AND THE CITIES OF CASSELBERRY, ALTAMONTE SPRINGS, LAKE MARY, LONGWOOD, OVIEDO, SANFORD, AND WINTER SPRINGS; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, in 1983 Seminole County approved Ordinance 83-22 imposing a county -wide four cent ($.04) fuel tax for a period of ten years to be used for transportation expenditures; and WHEREAS, in 1985 Seminole County amended the term of the four cent ($.04) fuel tax to 30 years with an expiration date of August 31, 2013 and added an additional two cent ($.02) fuel tax for 30 years to expire August 31, 2015; and WHEREAS, in 1986, Seminole County provided an Interlocal Agreement to the cities of Altamonte Springs, Casselberry, Lake Mary, Longwood, Oviedo, Sanford and Winter Springs noting the method for distribution of the local option gas tax proceeds among the County and the cities, which was approved by cities representing at least 50% of the County's total population pursuant to State Statute; and WHEREAS, the initial four cent ($.04) gas tax levy will expire on August 31, 2013 and Seminole County wishes to include the additional two cent ($.02) gas tax levy to extend and impose a combined six cent ($.06) gas tax levy for an additional 30 years, expiring August 31, 2043; and WHEREAS, a new Gas Tax Ordinance will be considered by the Seminole County Board of County Commissioners at their meeting on March 26, 2013 to levy and impose the combined six cent ($.06) gas tax for defined transportation expenditures; and WHEREAS, a re -stated Interlocal Agreement for the Shared Distribution of the Six Cent Local Option Motor Fuel and Diesel Fuel Tax has been provided designating how the proceeds from said levy will continue to be apportioned among the County and the seven cities listed above to be used for defined transportation expenditures; and WHEREAS, the City Manager and the Finance Director have reviewed said Interlocal Agreement and recommend its approval NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
