RESOLUTION 25-3492 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A COOPERATIVE AGREEMENT WITH THE <br />NATURAL RESOURCES CONSERVATION SERVICE FOR GEE CREEK <br />WATERSHED DEBRIS REMOVAL AND EROSION CONTROL DUE TO <br />HURRICANE MILTON; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry experienced significant debris and erosive damage <br />within the Gee Creek watershed as a result of Hurricane Milton in October 2024; and <br />WHEREAS, the City submitted an application to the United States Department of <br />Agriculture Natural Resources Conservation Service (USDA NRCS) in an effort to obtain a <br />grant to help fund improvements needed to address the aforementioned damage; and <br />WHEREAS, the USDA NRCS has agreed to award the City funding to assist with the <br />Gee Creek watershed debris removal and erosion control via a Cooperative Agreement; and <br />WHEREAS, said Agreement provides for a total amount of financial assistance not to <br />exceed $1,164,308.20 ($1,058,462.00 for construction and $105,846.20 for technical assistance), <br />and there is no required construction funding match from the City; and <br />WHEREAS, City staff has reviewed the Cooperative Agreement submitted by the <br />United States Department of Agriculture Natural Resources Conservation Services and finds it <br />favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Cooperative Agreement with the United States Department of Agriculture Natural Resources <br />Conservation Service for Gee Creek watershed debris removal and erosion control due to <br />Hurricane Milton, for a total amount not to exceed $1,164,308.20, and authorizes the City <br />Manager to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
