RESOLUTION 25-3492 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A COOPERATIVE AGREEMENT WITH THE NATURAL RESOURCES CONSERVATION SERVICE FOR GEE CREEK WATERSHED DEBRIS REMOVAL AND EROSION CONTROL DUE TO HURRICANE MILTON; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry experienced significant debris and erosive damage within the Gee Creek watershed as a result of Hurricane Milton in October 2024; and WHEREAS, the City submitted an application to the United States Department of Agriculture Natural Resources Conservation Service (USDA NRCS) in an effort to obtain a grant to help fund improvements needed to address the aforementioned damage; and WHEREAS, the USDA NRCS has agreed to award the City funding to assist with the Gee Creek watershed debris removal and erosion control via a Cooperative Agreement; and WHEREAS, said Agreement provides for a total amount of financial assistance not to exceed $1,164,308.20 ($1,058,462.00 for construction and $105,846.20 for technical assistance), and there is no required construction funding match from the City; and WHEREAS, City staff has reviewed the Cooperative Agreement submitted by the United States Department of Agriculture Natural Resources Conservation Services and finds it favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Cooperative Agreement with the United States Department of Agriculture Natural Resources Conservation Service for Gee Creek watershed debris removal and erosion control due to Hurricane Milton, for a total amount not to exceed $1,164,308.20, and authorizes the City Manager to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
