ORDINANCE 25-1.619 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />ADDING A NEW SECTION RELATING TO ELECTRONIC MESSAGE <br />CENTERS (EMC); AMENDING ARTICLE XVI, "SIGNS" OF CHAPTER <br />III, "PERFORMANCE CRITERIA", PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, OF THE CITY OF CASSELBERRY <br />CODE OF ORDINANCES BY AMENDING SECTION 3-16.2, <br />"DEFINITIONS"; SECTION 3-16.3 "ON -PREMISES PERMANENT SIGN <br />REGULATIONS"; SECTION 3-16.6 "RESERVED"; AND SECTION 3-16.8, <br />"PROHIBITED SIGNS" TO ALLOW ELECTRONIC MESSAGE <br />CENTERS UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the City desires to be responsive to businesses seeking better ways to attract <br />attention to their premises and intends to no longer prohibit the use of Electronic display type <br />signs; and <br />WHEREAS, studies have shown that electronic signs can be safely erected with certain <br />safeguards, including a long display time, sufficient for a driver to read the entire message before <br />it changes, and other standards; and <br />WHEREAS, studies have shown that electronic signs can pose a safety risk during darker <br />conditions at night and during storms, so this proposed ordinance includes a requirement of an <br />automatic dimmer, a maximum copy area for the electronic sign, and legible lettering; and <br />WHEREAS, the City Commission desires to also ensure that, with the addition of <br />electronic message centers into the City, residential properties shall be adequately protected from <br />disturbance and glare and that the aesthetic character of the City's commercial corridors will not <br />be overwhelmed by large, distracting electronic signs; and <br />WHEREAS, the City Commission desires to amend the Unified Land Development <br />Regulations to permit the use of Electronic Message Centers (EMCs), subject to limitations, to <br />ensure that the purpose and intent of the City's sign regulations are furthered as enumerated in <br />Section 3-16.1 of the ULDR; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and strike through type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />Ordinance 25-1619 <br />Page 1 of 6 <br />
