Any person seeking election to the City Commission who is unable to pay the one <br />percent qualifying fee without imposing an undue burden on his or her personal <br />resources or on resources otherwise available to the person shall, upon written <br />certification of such inability given under oath to the City Clerk, be exempt from <br />paying the one percent qualifying fee and may qualify to have his or her name placed <br />on the ballot by means of the following petitioning process: <br />(1) Upon receipt of the written oath from the candidate, the City Clerk <br />shall provide the candidate with petition forms in sufficient numbers to facilitate the <br />gathering of signatures required pursuant to this Section. The petition forms shall <br />indicate the seat for which the candidate is running. <br />(2) When the candidate has filed the oath and received the petition forms <br />prescribed herein, the candidate may begin to seek signatures on the petitions <br />supporting his or her candidacy. Only signatures of qualified electors of the City of <br />Casselberry shall be counted toward obtaining the number of signatures required in <br />this subsection. The candidate shall obtain 100 signatures of qualified electors or the <br />signatures of a number of qualified electors equal to at least two percent of the total <br />number of qualified electors, whichever is the lower. <br />(3) Each petition shall be filed with the City Clerk on or before the third <br />Tuesday in July. The City Cleric shall determine whether the required number <br />of signatures has been obtained for the name of the candidate to be placed on the <br />ballot and shall notify the candidate. <br />SECTION IL CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and <br />be made a part of the Charter of the City of Casselberry, Florida; that the Sections of this Ordinance <br />may be renumbered or re -lettered to accomplish such intention; that the word, "Ordinance" may be <br />changed to "Section," "Article," or other appropriate word. <br />SECTION III. CONFLICTS. All Ordinances or Resolutions, or parts of Ordinances or <br />Resolutions in conflict with any provisions of this Ordinance are hereby repealed to the extent of the <br />conflict. <br />SECTION IV. SEVERABILITY. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION V. EFFECTIVE DATE.
