RESOLUTION 13-2505 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT NO. 2 TO THE STATE REVOLVING FUND LOAN AGREEMENT (DW590301) WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, in September 2009, the Florida Department of Environmental Protection (FDEP) awarded the City $3M in stimulus grant and loans related to the American Recovery and Reinvestment Act (ARRA) to cover the costs associated with the construction of water quality improvement project areas throughout the City's water distribution system; and WHEREAS, via Resolution 09-2076, the City entered into an agreement (DW590300) with the Florida Department of Environmental Protection (FDEP) for grant/loan funding to construct the City's Water Quality Improvements Project; and WHEREAS, via Resolution 10-2187, the City entered into a separate agreement with FDEP (DW590310) for the construction of additional water quality improvements; and WHEREAS, via Resolution 11-2246, FDEP requests the City annul FDEP agreement DW590310 and re -write FDEP agreement (DW590301) for clarification purposes; and WHEREAS, via Resolution 12-2365, Commission approved Amendment No. 1 to the State Revolving Fund Construction Loan Agreement (DW590301) including $4,154,883.00 in additional grant/loan funding for Phase 3 of the Water Quality Improvement projects; and WHEREAS, City Staff have been working closely with FDEP staff to identify an additional $1 Million in available grant funding for the project; WHEREAS, FDEP has submitted Amendment No. 2 to the State Revolving Fund Construction Loan Agreement (DW590301) including $1,000,000 in additional grant fiunding for overruns encountered on Phase 3 of the Water Quality Improvement projects; and WHEREAS, the terms, conditions, and responsibilities as previously identified and agreed upon in the old agreements will remain unchanged in the new combined agreement; and WHEREAS, City staff have reviewed Amendment No. 2 to the State Revolving Fund Construction Loan Agreement (DW590301) submitted by FDEP and finds it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves Amendment No. 2 to the State Revolving Fund Construction Loan Agreement (DW590301) between the City of Casselberry and the Florida Department of Environmental Protection, and authorizes the Mayor to execute said document(s) on behalf of the City.
