RESOLUTION 12-2446 <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF <br />CASSELBERRY AND THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR <br />LANDSCAPING IMPROVEMENTS AND IRRIGATION MAINTENANCE PERTAINING TO THE <br />U.S. HIGHWAY 17-92 AND STATE ROAD 436 INTERCHANGE PROJECT; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, as a result of recent funding changes, the Florida Department of Transportation (FDOT) has <br />announced that the U.S. Highway 17-92 and SR 436 Interchange Project has been accelerated and budgeted <br />for construction in FDOT's fiscal year 2014, which commences July 1, 2013; and <br />WHEREAS, this project is a multi -agency transportation improvement project that is designed to ease <br />traffic congestion at the busy intersection of U.S. Highway 17-92 and SR 436 in Casselberry; and <br />WHEREAS, City staff wishes to upgrade FDOT's proposed landscaping and irrigation plans for the <br />project area to include features that reflect the City's vision and maintains aesthetic continuity along this major <br />corridor; and <br />WHEREAS, FDOT has submitted an agreement, for an amount not to exceed $128,000.00 without prior <br />written authorization, to implement said upgrades; and <br />WHEREAS, City staff has reviewed the agreement submitted by FDOT for landscaping improvements and <br />irrigation maintenance pertaining to the U.S. Highway 17-92 and SR 436 Interchange Project and finds it favorable <br />to meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission of the City of Casselberry hereby approves the agreement submitted by <br />the Florida Department of Transportation for landscaping improvements and irrigation maintenance for the U.S. <br />Highway 17-92 and SR 436 Interchange Project, in the amount not to exceed $128,000.00 without prior authorization, <br />and authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br />SECTION IV.
