RESOLUTION 09-2015 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF A COOPERATIVE PURCHASE <br />AGREEMENT BETWEEN MCLANE EXCAVATING COMPANY AND THE CITY <br />OF CASSELBERRY FOR THE GRASSY LAKE RE -VEGETATION PROJECT; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry's updated Stormwater, Lakes Management and Water <br />Quality Master Plan recommends increased frequency and extent of harvesting for aquatic plant <br />control; and <br />WHEREAS, Grassy Lake contains a significant encroachment of cattails and Carolina <br />willow; and <br />WHEREAS, the Stormwater, Lakes Management, and Water Quality Master Plan identifies <br />the revegetation of Grassy Lake as one of the priority capital improvement projects; and <br />WHEREAS, funding from the Stormwater Utility Fund for the revegetation of Grassy Lake <br />has been allocated in the Fiscal Year 2009 budget; and <br />WHEREAS, the City, in cooperation with the Florida Fish and Wildlife Conservation <br />Commission, has identified the need for cattail harvesting and thinning of Carolina willow within <br />Grassy Lake as part of the revegetation plan for the lake; and <br />WHEREAS, McLane Excavating Company has been competitively bid with Seminole <br />County and has performed similar services for the City; and <br />WHEREAS, Public Works staff has reviewed the proposal submitted by McLane <br />Excavating Company and has found it to be responsible and adequate to meet the project <br />requirements of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />cooperative purchase agreement with McLane Excavating Company, attached as "Exhibit A", and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
