RESOLUTION 09-2015 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A COOPERATIVE PURCHASE AGREEMENT BETWEEN MCLANE EXCAVATING COMPANY AND THE CITY OF CASSELBERRY FOR THE GRASSY LAKE RE -VEGETATION PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry's updated Stormwater, Lakes Management and Water Quality Master Plan recommends increased frequency and extent of harvesting for aquatic plant control; and WHEREAS, Grassy Lake contains a significant encroachment of cattails and Carolina willow; and WHEREAS, the Stormwater, Lakes Management, and Water Quality Master Plan identifies the revegetation of Grassy Lake as one of the priority capital improvement projects; and WHEREAS, funding from the Stormwater Utility Fund for the revegetation of Grassy Lake has been allocated in the Fiscal Year 2009 budget; and WHEREAS, the City, in cooperation with the Florida Fish and Wildlife Conservation Commission, has identified the need for cattail harvesting and thinning of Carolina willow within Grassy Lake as part of the revegetation plan for the lake; and WHEREAS, McLane Excavating Company has been competitively bid with Seminole County and has performed similar services for the City; and WHEREAS, Public Works staff has reviewed the proposal submitted by McLane Excavating Company and has found it to be responsible and adequate to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the cooperative purchase agreement with McLane Excavating Company, attached as "Exhibit A", and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
