ORDINANCE 24-1611 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE OFFICIAL ZONING MAP FROM <br />R-9 (LOW DENSITY SINGLE-FAMILY RESIDENTIAL) TO RMF -13 <br />(MEDIUM DENSITY MULTIFAMILY) FOR ONE PARCEL, TOTALING <br />APPROXIMATELY 2.79 ACRES, LOCATED AT 210 NE TRIPLET <br />DRIVE, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") is <br />within the City Boundary of the City of Casselberry; and <br />WHEREAS, the Property has a zoning designation of R-9 (Low density single-family <br />residential); and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, the proposed RMF -13 (Medium Density Multi -Family Residential) zoning <br />district is consistent with the City's MDR FLUM designation; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this Official Zoning Map amendment; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, determined that the requested zoning amendment is consistent with the City's <br />Comprehensive Plan FLUM and is in compliance with all applicable procedures of the Unified <br />Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida.; and <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That the Official Zoning Map established in Chapter II, Article IV, Section <br />2-4.3. of the Unified Land Development Regulations of the Code of Ordinances of the City of <br />Casselberry, Florida, as amended and supplemented, be, and the same is, hereby amended to <br />designate the Property described in "Attachment A," consisting of approximately 2.79 acres, from <br />R-9(Low Density Single -Family Residential) to RMF -13 (Medium Density Multi -Family <br />Residential), as shown in "Attachment B". <br />SECTION II. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are hereby repealed to the extent of the conflict. <br />SECTION III. SEVERABILITY. If any Section or portion of a Section of this Ordinance <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION IV. EFFECTIVE DATE. This Ordinance shall become effective <br />immediately upon the effective date of Ordinance No. 24-1610 as adopted by the City Commission <br />
