The expiration of the conditional use shall mirror the expiration provided for final site <br />plan approval. <br />7. Anew conditional use application shall be required if the use should cease for more than <br />90 days. <br />8. All of the above conditions shall be fully and faithfully executed, or the conditional use <br />shall become null and void. <br />Discussion: Commission discussion ensued, and Chairman Bakalla asked if the applicant would <br />come forward. The applicant was not present. <br />Audience Participation: No one came forward to address this item. <br />MOTION: Mr. Bryan moved to approve CU 23-05, Conditional Use Request at 386 <br />S.R. 436 based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the City <br />Code of Ordinances and the Unified Land Development Regulations <br />(ULDR) and is consistent with the Comprehensive Plan as per the <br />written findings contained within the staff report, subject to the <br />conditions 1-8 as presented. Motion was seconded by Mr. Minnis. The <br />motion passed unanimously by voice vote. <br />B. CU 23-07: 863 S.R. 436 - Conditional Use Request <br />Staff Presentation: Hunter McFerrin, Planner I, presented to the Planning and Zoning <br />Commission case number CU 23-07. The applicant, Iliana M. Araujo Gutierrez, requests to sell <br />beer and wine for on-site consumption at a new restaurant, B -Town Burger & Sushi. ULDR Table <br />2-5.3 notes that the sale of Alcoholic Beverages for On -Site Consumption requires conditional use <br />approval from the Planning and Zoning Commission. The subject property consists of two <br />multitenant buildings, and the applicant has obtained business tax receipts for two suites in one of <br />them. This considered, the restaurant will be located at 863 S.R. 436 and an office/administrative <br />space for the business will operate in the suite next door at 861 S.R. 436. The restaurant will be <br />open from 11 a.m. to 10 p.m. daily and consist of approximately eight employees.
