RESOLUTION 24-3436 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO DUKE ENERGY FLORIDA, LLC AT "WHEEL PARK" — PHASE 1 & 2,951/952 N. WINTER PARK DR, PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry has completed design of "Wheel Park" — Phase 1 & 2, located at 951/952 N. Winter Park Dr; and WHEREAS, the City has identified the need for power distribution line/pole improvements at "Wheel Park" — Phase 1 & 2; and WHEREAS, to accommodate the improvements, Duke Energy Florida, LLC will need to make utility adjustments which will require an easement from the City; and WHEREAS, a conveyance of easement, attached hereto as "Attachment A", will provide the necessary easement to accommodate the required utility adjustment to be made by Duke Energy Florida, LLC at "Wheel Park" — Phase 1 & 2, 951/952 N. Winter Park Dr; and WHEREAS, City staff has reviewed the easement and finds it acceptable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the conveyance of an easement to Duke Energy Florida, LLC for "Wheel Park" — Phase I & 2, 951/952 N. Winter Park Dr, parcel IDs 04-21-30-526-0000-0080 & 04-21-30-526-0000-0020, as provided in "Attachment A", and authorizes the Mayor to execute said document on behalf of the City. SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this day of J �� , AD 2024.
