Staff finds the conditional <br />use process to be redundant since a lot of the same type of evaluation is done through other methods, <br />including review of the request for sign -off on the Florida Department of Business and Professional <br />Regulation licensing application, which includes zoning check and distance separation requirements. There <br />are no plans to remove any current standards related to service of alcohol for on-site consumption, just the <br />requirement for conditional use. Business Tax Receipt review also includes checking for zoning and <br />general compliance, including site deficiencies such as parking or landscaping and there is a separate review <br />from the Utilities Division to ensure that there is an appropriate grease interceptor on site. Overall, staff <br />would like to correct these inconsistencies and redundancies to refine the existing regulations and to remove <br />unnecessary barriers for the benefit of the community's economic development activities. <br />Budget Impact: There is no impact on the City's budget. <br />Recommendation: The City Manager and the Community Development Director recommended adoption <br />of Ordinance 24-1607 on second and final reading. <br />Public Hearing: Mayor Henson stated this was a public hearing to hear and consider comments and <br />questions regarding Ordinance 24-1607. Mayor Henson opened the floor for public participation. No one <br />came forward to address Ordinance 24-1607. Mayor Henson closed the public hearing relative to <br />Ordinance 24-1607. <br />MOTION: Commissioner Divita moved to adopt Ordinance 24-1607 on second and final <br />reading, as presented. Motion was seconded by Commissioner Busch. <br />Motion carried unanimously by voice vote 4-0. <br />D. Public Hearing: Resolution 24-3463 — Adoption of Fiscal Year 2024-2025 Final <br />Millage Rate and Voted Debt Millage Rate <br />Mayor Henson announced for the record that the public hearing to consider adoption of the City of <br />Casselberly's final millage rate and voted debt millage rate for Fiscal Year 2024-2025 would now begin. <br />The City Clerk read Resolution 24-3463 by title, as follows: <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, ADOPTING THE FINAL MILLAGE RATE AND THE VOTED DEBT MILLAGE <br />RATE FOR THE CITY OF CASSELBERRY FOR THE FISCAL YEAR COMMENCING <br />OCTOBER 1, 2024 AND ENDING SEPTEMBER 30,2025; ANNOUNCING THE ROLLED -BACK <br />MILLAGE RATE, THE PERCENTAGE BY WHICH THE MILLAGE EXCEEDS THE ROLLED - <br />BACK RATE AND THE FINAL MILLAGE RATE TO BE LEVIED; PROVIDING FOR <br />CONFLICTS, SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 24-3463 adopting the final <br />millage rate for Fiscal Year 2024-2025 was advertised in the Orlando Sentinel on Thursday, September 19, <br />2024 in accordance with Truth in Millage (TRIM) legislation requirements and the rules of the Florida <br />Department of Revenue. <br />
