ORDINANCE 24-1608 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 86, UTILITIES, ARTICLE III, WATER OF THE <br />CODE OF ORDINANCES, SECTIONS 86-189(4),86-266,86-267,86-268, TO <br />INCREASE RATES FOR POTABLE IRRIGATION FOR BACKFLOW <br />TESTING AND TO UPDATE THE CROSS -CONNECTION CONTROL <br />CODE; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry's Cross Connection Control Code was last updated <br />in 1993 to introduce the Cross Connection Control Program and backflow requirements as per the <br />rules and regulations of the Florida Department of Environmental Protection; and <br />WHEREAS, the City has identified the need to modernize Code sections for the Cross <br />Connection Control Program; and <br />WHEREAS, the City has recognized the difficulties for residents on the Cross Connection <br />Control Program to obtain sufficient contractors for potable irrigation backflow testing; and <br />WHEREAS, the City desires to update the City Code in order to modernize the Code, and <br />allow the City to offer a residential testing program for potable irrigation customers; and <br />WHEREAS, following due and proper notice as required by Florida Statute Section <br />180.136, the City Commission held a public hearing to update the Code and consider a potable <br />irrigation water rate increase at the City Commission meeting on September 23, 2024; and <br />WHEREAS, at said hearing, the City Commission considered the testimony of all <br />interested persons and the documents in the file; and <br />WHEREAS, pursuant to Section 180.13(2), Florida Statutes, the City Commission is <br />authorized to establish just and equitable rates and charges to be paid for the use of the municipal <br />utility by each person, firm or corporation whose premises are served by the utility; and <br />WHEREAS, the slight potable irrigation rate increase bears a substantial relationship to <br />the approximate $40,000 cost to the City for the City to provide its customers the residential testing <br />program; and <br />WHEREAS, the professional staff of the Public Works & Utilities Department, and the <br />Public Works & Utilities Director, after a study and review of the utility's rates and structures, <br />recommends that a slight change in potable irrigation rates is appropriate at this time to absorb the <br />cost of the residential testing program. <br />Ordinance 2024-1608 <br />Page 1 of 6 <br />
