RESOLUTION 24-3455 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF CHANGE ORDERS FOR GEE CREEK AND HOWELL <br />CREEK EROSION CONTROL DUE TO HURRICANE IAN; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry experienced significant erosive damage within the <br />Gee Creek and Howell Creek drainage basins as a result of Hurricane Ian in September 2022; <br />and <br />WHEREAS, the United States Department of Agriculture Natural Resources <br />Conservation Service (USDA NRCS) has agreed to award the City funding to assist with the <br />erosion control in Gee Creek and Howell Creek basins via a Cooperative Agreement; and <br />WHEREAS, said Agreement provides for a total amount of financial assistance not to <br />exceed $812,830.49 ($727,830.49 for construction and $85,000.00 for technical assistance), and <br />a required 25% construction funding match (or $242,610.16) from the City; and <br />WHEREAS, ITB 2024-1135 was awarded to Enviro-Tech System Inc. for a total <br />construction agreement amount of $970,440.65 for the Gee Creek and Howell Creek Erosion <br />Control Projects; and <br />WHEREAS, unforeseen site conditions at Howell Creek at Carmel by the Lake <br />Condominium site lead to design changes and corresponding change orders. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby authorizes the City <br />Manager to execute change orders for Gee Creek and Howell Creek erosion due to Hurricane <br />Ian, under ITB 2024-1135 with Enviro-Tech System Inc. for a total amount not to exceed <br />$108,522.03. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED and ADOPTED this 14" day of �j�e�.�y�► bei" , AD 2024. <br />
