ORDINANCE 24-1605 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 46, FLOODS OF PART II, CODE OF <br />ORDINANCES OF THE CITY OF CASSELBERRY TO CONFORM TO <br />COMMUNITY RATING SYSTEM REQUIREMENTS; BY AMENDING <br />SECTION 46-1, "DEFINITIONS" WITHIN ARTICLE I, "IN GENERAL"; <br />AND BY AMENDING SECTION 46-64, "MANUFACTURED HOMES" <br />WITHIN ARTICLE III, "FLOOD HAZARD REDUCTION STANDARDS"; <br />PROVIDING FOR APPLICABILITY, CODIFICATION, CONFLICTS, <br />SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, the Legislature of the State of Florida has, in Chapter 166 — Municipalities, <br />Florida Statutes, conferred upon local governments the authority to adopt regulations designed to <br />promote the public health, safety, and general welfare and prosperity of the residents of the City; <br />and <br />WHEREAS, the City of Casselberry participates in the National Flood Insurance Program <br />(NFIP) and participates in the NFIP's Community Rating System (CRS), a voluntary incentive <br />program that recognizes and encourages community floodplain management activities that exceed <br />the minimum program requirements and achieves a CRS rating of Class 8 making citizens who <br />purchase NFIP flood insurance policies eligible for premium discounts; and <br />WHEREAS, in 2020, the NFIP Community Rating System established certain minimum <br />prerequisites for communities to qualify for or maintain class ratings of Class 8 or better; and <br />WHEREAS, to satisfy the prerequisite and for the City of Casselberry to maintain the <br />current CRS rating, all manufactured homes installed or replaced in special flood hazard areas <br />must be elevated to or above at least the base flood elevation plus 1 foot, which necessitates <br />modification of the existing requirements; and <br />WHEREAS, the City Commission determined that it is in the public interest to amend the <br />floodplain management regulations to better protect manufactured homes and to continue <br />participating in the Community Rating System at the current class rating; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and stfike through type shall constitute deletions to the original text; and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to the adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Legislative Findings. The above recitals are hereby adopted as the <br />legislative findings of the City Commission.
