Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />July 12, 2023 <br />Page 3 <br />Discussion: Ed McDonald, Applicant, 178 Northshore Circle, came forward and addressed the <br />Commission. <br />Audience Participation: No one came forward to address this item. <br />MOTION: Mr. Bryan moved to approve CU 23-03, a conditional use request at 178 Northshore <br />Circle, based upon the staff report and the testimony and evidence presented that <br />the request meets the applicable provisions of the City Code of Ordinances and the <br />Unified Land Development Regulations and is consistent with the Comprehensive <br />Plan as per the written findings contained within the staff report, subject to the <br />eight conditions as presented. Motion was seconded by Mr. Kirk. The motion <br />passed unanimously by voice vote. <br />6. Site Plan Application <br />A. SPR 23-08: 5803 S. U.S. Hwy 17-92 — Site Plan Approval Request <br />Staff Presentation: Chief Planner, Antonia DeJesus, presented Project SPR 23-08 to the Planning and <br />Zoning Commission, which was a request for site plan approval for a Development of Community Impact <br />(DCI) to redevelop the subject property, 5803 S US Hwy 17-92, with a large retail establishment, BJs <br />Wholesale Club, while retaining the existing retail outparcels. <br />Staff recommended Commission approval of case number SPR 23-08, based on the staff report and the <br />testimony and evidence presented, that the request meets the applicable provisions of the Unified Land <br />Development Regulations, and is consistent with the Comprehensive Plan as per the written findings <br />contained in the staff report and conditions 1-5 and attachments 1-8. <br />1. The site plan approval shall be valid for one(]) year; an extension request may be submitted <br />prior to the expiration of this approval. <br />2. All remaining comments conveyed to the applicant via the DRC Comment Report dated July 10, <br />2023, and at the DRC Meeting held on July 10, 2023, shall be addressed and considered resolved <br />by staff before an engineering permit may be issued. <br />3. Additional on-site lighting shall not be installed without the review and approval of an updated <br />photometric plan by the City's Planning Division to ensure compliance with ULDR Section 3- <br />10.6. <br />4. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />the commencement of development. <br />5. All of the above conditions shall be fully and faithfully executed, or the site plan shall become <br />null and void. <br />
