RESOLUTION 24-3424 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT AGREEMENT WITH AUSTIN RICCI AND TORI LYNN RICCI ON PARCEL ID: 28-21-30-503-0000-0410 (645 BROOKWOOD LANE); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City owns public utilities located on Parcel ID: 28-21-30-503-0000-0410 (645 Brookwood Lane) which are not currently within an approved utility easement; and WHEREAS, the property owners, Austin Ricci and Tori Lynn Ricci, have agreed to grant a utility easement over a portion of the property for the necessary construction, installation, operation, maintenance, and repair of public utilities; and WHEREAS, Public Works & Utilities Department staff has reviewed the Utility Easement Agreement with Austin Ricci and Tori Lynn Ricci and find it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Utility Easement Agreement with Austin Ricci and Tori Lynn Ricci on Parcel ID: 28-21-30-503-0000- 0410 (645 Brookwood Lane), attached hereto, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
