RESOLUTION 24-3438 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING EXECUTION OF AN <br />INDEMNIFICATION AGREEMENT IN FAVOR OF THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION (FDOT) REQUIRED BY <br />FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) <br />AND FDOT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry was awarded a brownsfield grant to remediate the <br />former Police Department site, and FDEP is now ready to issue a No Further Action letter premised <br />upon the City taking certain actions; and <br />WHEREAS, one of the requirements is that the City execute the attached Indemnification <br />Agreement in favor of FDOT. <br />NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. That the City Commission of the City of Casselberry hereby approves the <br />attached Indemnification Agreement in favor of FDOT and authorizes the Mayor to execute said <br />Indemnification Agreement, and any related documents for and on behalf of the City of Casselberry. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />SECTION 4. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />PASSED and ADOPTED this day of , A.D., 2024. <br />ATTEST: <br />onna G.
