RESOLUTION 24-3430 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AN AGREEMENT CONCERNING ONE-TIME PAYMENT FOR ROAD REPAIRS AT WINDWARD SQUARE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City recently upgraded all the utility infrastructure in the Windward Square community, including installing new potable water service lines and water mains which involved significant damage to the private roadways ("Utility Improvements"); and WHEREAS, the Windward Square residents and the Windward Square Homeowners Association provided significant cooperation in the completion of the Utility Improvements which allowed the City to facilitate the project with cost savings, and the Association wishes to oversee the repaving of their roadways; and WHEREAS, in lieu of conducting the road restoration, the City will make a one-time lump sum payment of $972,345.00 toward the repair of the private roads; and WHEREAS, City staff has reviewed the Agreement Concerning One -Time Payment for Road Repairs at Windward Square and have found it favorable to meet the needs of the City and the Windward Square residents. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves the Agreement Concerning One -Time Payment for Road Repairs, attached herewith, and approves payment to the Windward Square Homeowners Association, Inc., in the amount of $972,345.00, and authorizes the Mayor to execute said Agreement on behalf of the City. SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION 4. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this 9 I y day of,r 1 , AD 2024.
