These proceedings are quasi-judicial in nature. Formal rules <br />of evidence shall not apply, but fundamental due process shall be observed and shall govern all proceedings. All <br />testimony shall be under oath and shall be recorded. At the conclusion of each hearing, the Code Enforcement Special <br />Magistrate shall issue Findings of Fact, based on the evidence of record and conclusions of law, and shall issue an <br />order affording the proper relief consistent with the powers of the Special Magistrate. The order may include a notice <br />that it must be complied with by a specified date, and that a fine may be imposed. All participants must have an active <br />role in the case, for example: Special Magistrate, staff, respondent and/or witness. <br />Persons are advised that if they decide to appeal any decisions made at these meetings/hearings they will need a <br />record of the proceedings and for such purpose, they may need to ensure that a verbatim record of the proceedings is <br />made which record includes the testimony and evidence upon which the appeal is to be based per Section 286.0105, <br />Florida Statutes. <br />Persons with disabilities needing assistance to participate in any of these proceedings should contact the City of <br />Casselberry A.D.A.
