RESOLUTION 21-3274 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, ESTABLISHING FEES RELATING TO AN <br />APPLICATION FOR A REQUEST FOR A LIEN REDUCTION FROM <br />CODE ENFORCEMENT ACTIONS AND THE TIMELY APPEAL OF <br />RELATED DECISIONS; PROVIDING FOR THE ESTABLISHMENT OF A <br />FEE SCHEDULE, CONTINUANCE IN FORCE, CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry (City) is granted the authority, under Section 2(b), <br />Article VIII, of the Florida State Constitution, to exercise any power for municipal purposes, <br />except when expressly prohibited by law; and <br />WHEREAS, the Code of Ordinances of the City of Casselberry, Florida, (Code) contains <br />provisions allowing for Code compliance violators, or the violator's successors or assigns <br />(collectively, "Applicant"), to apply for forgiveness or reduction of an existing code enforcement <br />lien through submission of a City of Casselberry Application for a Request.for a Lien Reduction; <br />herein referred to as a lien reduction application; and <br />WHEREAS, on October 11, 2021, the City Commission of the City of Casselberry <br />adopted Ordinance 21-1558, thereby amending the City's procedures for lien reduction <br />applications for Applicants to formally request a lien reduction from the City; and <br />WHEREAS, the Ordinance provided for a non-refundable application fee to be submitted <br />by the Applicant at the time of submitting a lien reduction application for consideration by and <br />timely appeal to the City Manager for a decision as to Applicant's lien reduction application; and <br />WHEREAS, the City Commission finds that the proposed fee amounts, based on research <br />of similar fee amounts established by other governments, are reasonable, affordable, and serve to <br />encourage compliance with the City Code; and <br />WHEREAS, the City Commission desires to establish lien reduction application fee <br />amounts to ensure that Applicants are encouraged to attain compliance with the City's Code and <br />to be treated fairly in their pursuit to reduce liens upon their property upon compliance; and <br />WHEREAS, the City Commission of the City of Casselberry has determined it to be in <br />the best interest of City residents and the community overall to establish the fees provided for <br />herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA: <br />
