ORDINANCE 24-1598 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY ZONING MAP AS <br />ESTABLISHED IN CHAPTER II, ARTICLE IV, SECTION 2-4.3, OF THE <br />UNIFIED LAND DEVELOPMENT REGULATIONS, CODE OF <br />ORDINANCES OF THE CITY OF CASSELBERRY, FLORIDA, AS <br />AMENDED AND SUPPLEMENTED; AMENDING THE ZONING <br />CLASSIFICATION FROM SEMINOLE COUNTY C-1 (COMMERCIAL) <br />TO CITY OF CASSELBERRY PMX-MID (PLANNED MIXED USE: <br />MEDIUM -RISE) FOR APPROXIMATELY 0.82 ACRES, LOCATED AT <br />1550 S.R. 436, AS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") <br />was recently annexed into the City of Casselberry (City) corporate boundaries by Ordinance 23- <br />1589; and <br />WHEREAS, the Property was designated with City of Casselberry Major Thoroughfare <br />Mixed -Use Future Land Use Map (FLUM) designation via Ordinance 24-1596; and <br />WHEREAS, the Property needs a City zoning district classification; and <br />WHEREAS, the PMX-MID (Planned Mixed Use: Medium -Rise) zoning district is <br />consistent with the City's Major Thoroughfare Mixed -Use future land use designation; and <br />WHEREAS, the Property is to remain as -is, and there are no additions or modifications <br />proposed to the Property; and <br />WHEREAS, whenever significant modifications are proposed to the Property, approval <br />of a P1amled Unit Development (PUD) Agreement and an associated Concept Plan is required <br />per Article XX, of Chapter IV, of the Unified Land Development Regulations, Code of <br />Ordinances of the City of Casselberry, Florida, to provide relevant development and <br />performance standards for the Property; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this Official Zoning Map amendment; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, determined that the requested zoning amendment is consistent with the City's <br />Comprehensive Plan FLUM and is in compliance with all applicable procedures of the Unified <br />Land Development Regulations, Code of Ordinances of the City of Casselberry, Florida.; and <br />WHEREAS, based on the foregoing, the City Commission of the City of Casselberry has <br />determined the zoning classification of said property shall be PMX-MID (Planned Mixed Use: <br />Medium -Rise), as that district is defined in Articles IV and V of Chapter II, as amended and <br />supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of <br />Casselberry, Florida. <br />
