.� <br />• <br />(f) Expiration and Extension of Public Health Emergency Orders <br />Limiting Rights and Liberties. <br />1) As used in this subsection only, the term "Public Health Emergenc <br />Order limiting rights and liberties" means an order or ordinance issued or <br />enacted by the City in response to a non -weather related emergency <br />pursuant to Chapter 252 or chapter 381 of the Florida Statutes that limits <br />the rights or liberties of individuals or businesses within the City. The term <br />does not apply to orders issued in response to hurricanes or other weather- <br />related emergencies, which are addressed in Subsection (g) below. <br />2) A Public Health Emeraencv Order that limits riahts or liberties must <br />be narrowly tailored to serve a compelling public health or safety purpose. <br />Any such emergency order must be limited in duration, applicability, and <br />scope in order to reduce anv infringement on individual riahts or liberties <br />to the greatest extent possible. <br />3) A Public Health Emergency Order limiting rights or liberties <br />automatically expires 7 days after issuance but may be extended by a <br />majority vote of the City Commission as necessary, in 7 -day increments <br />for a total duration of not more than 42 days. <br />(g) Expiration and Extension of "Weather Emergency" Orders or any <br />Emergency Order not limiting rights or liberties. <br />(1) The duration of each local state of "weather emergency" or any <br />Emergency Order not limiting rights or liberties is limited to 7 days; it may <br />be extended, as necessary, in 7 -day increments by the City Commission <br />The City Manager may extend the "weather emergency order" in 7 -day <br />increments if delegated authority by the City Commission, or if the nature <br />of the Weather Emergency makes a Commission meeting impractical. <br />(2) The provisions of Subsection (g) do not apply to weather emergency <br />orders or any order not limiting rights or liberties. <br />Ordinance No. 24-1593 <br />Page 8 <br />
