RESOLUTION 21-3262 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF THE SUNSET DRIVE LIVABLE STREETS (FROM OXFORD ROAD TO BUTTON ROAD) PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry is committed to making its coininunity safer, more comfortable, and more connected for people of all ages and abilities to walk and bike; and WHEREAS, in 2012 the City submitted an application to MetroPlan Orlando to request funding for the Sunset Drive Livable Street Improvements Project (a.k.a. "Sunset Drive Livable Streets (from Oxford Road to Button Road) Project"), which includes significant bicycle and pedestrian -oriented improvements along the North and South Sunset Drive corridor; and WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City identified the aforementioned project as an unfunded need; and WHEREAS, design and construction of the proposed improvements using federal funds was programmed into the State of Florida Department of Transportation's (FDOT's) Work Program for State Fiscal Year (FY) 2019-2020 and FY 2021-2022, respectively; and WHEREAS, design of the project has been completed using federal funds; and WHEREAS, a Local Agency Program (LAP) Agreement with FDOT is necessary in order to be able to construct the project using federal funds; and WHEREAS, FDOT has provided a proposed LAP Agreement for this purpose; and WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION L The City Commission of the City of Casselberry hereby approves the Local Agency Program Agreement with the State of Florida Department of Transportation for the construction of the Sunset Drive Livable Streets (from Oxford Road to Button Road) Project and authorizes the Mayor to execute said document, attached herewith, on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
