First Reading of Ordinance 24-1591 — Providing; for the Voluntary Annexation of One (1) <br />Parcel Located at 2075 Howell Branch Road <br />The City Clerk read Ordinance 24-1591 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND INCLUDING <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN <br />LANDS GENERALLY LOCATED AT 2075 HOWELL BRANCH ROAD; REDEFINING THE <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE <br />INTERIM PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE PROPERTY TO BE ANNEXED SHALL BE <br />ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING THE CITY <br />CLERK TO FILE COPIES OF THE ORDINANCE WITH THE SEMINOLE COUNTY CLERK <br />OF THE CIRCUIT COURT, THE CHIEF ADMINISTRATIVE OFFICER OF SEMINOLE <br />COUNTY, AND THE FLORIDA DEPARTMENT OF STATE; AND PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Staff Presentation: Planner Hunter McFerrin gave an overview of Ordinance 24-1591 which annexes to <br />and includes within the corporate limits of the City of Casselberry one (l) parcel located at 2075 Howell <br />Branch Road, comprised of approximately 1.79 acres. Presently unincorporated and under the jurisdiction <br />of Seminole County, the subject property has a Seminole County Future Land Use Map (FLUM) <br />designation of Office (OFF) and an Office (OP) zoning designation. The property proposed for annexation <br />is contiguous to the municipal boundary of the City of Casselberry; is well-defined and is a reasonably <br />compact area; is not included within the boundary of any other municipality; and does not create an enclave <br />as defined by Section 171.031(13) of the Florida Statutes. Proper notice of the City's intent to annex will <br />be provided to Seminole County at least ten (10) days prior to advertising the action for City Connnission <br />approval in accordance with Florida Statutes Section 171.044 relating to voluntary annexation. If approved <br />on first reading a Notice of Public Hearing advertisement will be placed in the Orlando Sentinel for two <br />consecutive weeks prior to the City Commission's second reading and public hearing for adoption. After <br />adoption, the City Clerk will notify the Seminole County Clerk of the Circuit Court, the Chief <br />Administrative Officer of the County, and the Department of State within seven (7) days of the adoption. <br />Once the subject property is annexed into the City, the applicants intend to apply to the City for a Future <br />Land Use Designation of Commercial (C) and a Zoning Designation of Office/Residential (OR) which are <br />consistent with the City's Unified Land Development Regulations (ULDR) Section 2-4.2 and the City's <br />Comprehensive Plan to support their plans for development of the property with a multi -tenant <br />office/commercial building. The property currently receives City water, sewer, and police services. <br />Seminole County provides fire services to the property. <br />Budget Impact: There is no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 24-1591 on first reading. <br />
