RESOLUTION 24-3402 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPOINTING AND REAUTHORIZING AN AGREEMENT WITH FISHBACK DOMINICK LLP, TO SERVE AS THE CODE ENFORCEMENT SPECIAL MAGISTRATE FOR THE CITY OF CASSELBERRY, PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Casselberry currently provides for code enforcement of its Code of Ordinances in Chapter 2, Article IV, Division 2, Code Enforcement Board; and WHEREAS, Ordinance 13-1400 amended the City of Casselberry Code of Ordinances to create an alternate method of code enforcement and nuisance abatement procedures through a Code Enforcement Special Magistrate, pursuant to Section 162.03(2), Florida Statutes; and WHEREAS, a Letter of Interest for the City of Casselberry Special Magistrate position was advertised, and three (3) proposals were received and reviewed by a selection committee comprised of City staff members, per Section 2-149 of the City of Casselberry Code of Ordinances; and WHEREAS, Fishback Dominick LLP, received the highest rank from the selection committee and was selected to serve as the City's Code Enforcement Special Magistrate at a rate of $275.00/hour, which covers all costs and expenses, and by Resolution 22-3327, the Commission appointed Andrew Mai of the firm as Special Magistrate; due to his resignation, this Resolution serves to appoint the law firm, rather than any particular attorney, to serve that role. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby appoints Fishback Dominick LLP, to serve as the City's Code Enforcement Special. SECTION II. Conflicts. All Resolutions, or parts of Resolutions, including Resolution 22-3327, in conflict with any provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this I Q+" day of e jDC! �^tet , AD 2024.
