If not corrected by the compliance date, the Enforcement Board shall notify the <br />Governing Body, which may make all reasonable repairs which are required to bring the property <br />into compliance and charge the violator with the reasonable cost of the repairs along with the fine. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-000998, located at 70 N <br />Sunset Drive was in violation of the City Code Sections as listed on the notice of code violation, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the respondent shall cure the violations by 1:00 P.M. October 5, 2023. If there is no compliance <br />by October 5, 2023, then a fine of $250.00 per day will be imposed for each day the property <br />remains in non-compliance. The City is authorized, pursuant to State law to make necessary and <br />reasonable repairs to make the property safe. A subsequent hearing will be held on October 19, <br />2023, to determine if compliance has been achieved. <br />Ms. Nix stated she was not asking the Special Magistrate to tell the City to make the repairs but <br />under the statute to notify the local Governing Body, which is the City staff would let the City <br />Commission know and they would authorize the repairs. The Special Magistrate stated okay. <br />13. CE -23-001097: New Case at 1430 S.R. 436 Violation — City Code 3-16.11 Sign maintenance, <br />City Code 3-10.3.a.2 Buildings and accessory structure damage/graffiti. <br />Staff Presentation: William Andreone, Senior Code Compliance officer gave testimony that the property <br />was reinspected and found to remain in violation on September 18, 2023. The City requested a correction <br />date of October 18, 2023. If no compliance by October 18, 2023, then a fine of $100.00 per day should <br />then be imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of <br />October 19, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to <br />speak about this case, there was no one present. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-001097, located at 1430 SR 436 was <br />in violation of the City Code Sections as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. CE -23-001106: New Case at 671 Crestview Drive Violation — City Code 3-10.9.c.l.a <br />Recreational equipment (utility trailers, RV, camper, atv, etc). <br />Staff Presentation: Tyler Hall, Code Compliance Officer gave testimony that the property was reinspected <br />and found to remain in violation on September 18, 2023. The City requested a correction date of October <br />18, 2023. If no compliance by October 18, 2023, then a fine of $75.00 per day should then be imposed for <br />each day of non-compliance thereafter. The City requests a subsequent hearing date of October 19, 2023, <br />to determine compliance. The Special Magistrate asked if there was anyone present to speak about this case, <br />there was a representative present to speak about this case. <br />
