RESOLUTION 23-3391 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING THE DONATION OF REAL PROPERTY FROM BRANCH TREE HOMEOWNERS ASSOCIATION, INC.; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Casselberry gratefully accepts the proposed donation of real property known as a park located at 2002 Water Lane, Maitland, Florida, (Parcel ID. 28-21-30-511-OPOI -0000), and a drainage retention area (Parcel ID. 28-21-30-51 1- OA00-0000), from Branch Tree Homeowners Association, Inc. WHEREAS, Branch Tree Homeowners Association, Inc. ("HOA") wishes to donate to the City of Casselberry (the "City") a park and drainage retention area located in the Branch free subdivision and more particularly described as follows (the "Property"): Tract A, Drainage Retention Area; and Park lying East of Lot 1213; BRANCH TREE, according to the map or plat thereof as recorded in Plat Book 26, Page 50, Public Records of Seminole County, Florida. Parcel ID. 28-21-30-511-OPO1-0000 and Parcel ID. 28-21-30-511-OA00-0000. WHEREAS, the HOA has acknowledged that the City of Casselberry has been maintaining the Property for more than 20 years; and WHEREAS, that the HOA believes that the Property was dedicated to the City of Casselberry by Olin American Homes of Florida, Inc., by the plat for Branch Tree, recorded in Plat Book 26, Page 50, Public Records of Seminole County, Florida, and as further evidenced by that certain Warranty Deed from Richmond American Homes, Inc., successor in title, to Branch Tree Homeowners Association, Inc., recorded in O.R. Book 1539, Page 1006, Public Records of Seminole County, Florida, which excluded "all those portions of said plat lying within a dedicated roadway or property otherwise dedicated to the City of Casselberry, Florida;" and WHEREAS, the HOA has executed a Quit -Claim Deed, Bill of Sale and Corporate Resolution which are attached hereto as composite Exhibit "A" conveying the Property to the City. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. That the City Commission hereby approves and accepts the conveyance of Property as evidenced by the executed Quit -Claim Deed, Bill of Sale and Corporate Resolution attached as Exhibit "A".
