RESOLUTION 10-2197 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN <br />THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION <br />AND THE CITY OF CASSELBERRY FOR THE BAFFLE BOX WITH <br />MEDIA FILTER INSTALLATION, EFFECTIVENESS EVALUATION, <br />AND ASSOCIATED EDUCATION FOR THE LAKE JE SUP WATERSHED <br />PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry understands the importance of surface water duality <br />and as a result has adopted a Stormwater, Lakes Management, and Water Quality Master Plan; and <br />WHEREAS, the City actively participated in the development of and expressed support <br />for the Lake Jesup Basin Management Action Plan to reduce pollutant loads to this impaired <br />waterbody; and <br />WHEREAS, the City applied to Florida Department of Environmental Protection (FDEP) <br />for consideration of a TMDL Water Quality Restoration Grant to assist with construction and <br />effectiveness evaluation of baffle boxes in the Gee Creek and Howell Creek basins, both of which <br />contribute to Lake Jesup; and <br />WHEREAS, FDEP has proposed to provide $250,000 in funding assistance for this <br />project; and <br />WHEREAS, the City's Stormwater, Lakes Management, and Water Quality Master Pian <br />calls for the construction of the proposed baffle boxes, as well as public education, both of which <br />are components of this project; and <br />WHEREAS, this project will reduce pollutant loads generated within the City and <br />discharged into Gee Creek and Howell Creek receiving waters; and <br />WHEREAS, City staff have reviewed the proposed Agreement and find it to be consistent <br />with the City's adopted Stormwater, Lakes Management, and Water Quality Master Plan and <br />financially beneficial to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Agreement between FDEP and the City of Casselberry (attached as `Exhibit A"), and authorizes <br />the Mayor to execute said document on behalf of the City. <br />SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION HI. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
