WHEREAS, specifically, the City finds an amendment to Table 3-13.7.(C1) desirable to include considerations, when needed due to site constraints, for minimum necessary encroachments into landscape buffers for passive recreational uses, such as sidewalks or shared -use paths, only for properties with Recreation and Open Space FLUM use designation and zoned ROS, subject to approval procedures outlined in ULDR Article XVII, Site Plan Review; and WHEREAS, the City also finds an amendment to ULDR 3-13.7.C.2.9, regarding exceptions for accessways through landscape strips along the public right-of-way, should include an exception for active transportation modes, such as sidewalks and shared -use paths, in addition to vehicular traffic; and WHEREAS, the City Commission of the City of Casselberry, Florida, hereby finds this Ordinance to be in the best interest of the public health, safety, and welfare of the citizens of Casselberry and the general public while promoting the goals, objectives, and policies in the City's Comprehensive Plan related to enhanced multimodal mobility and improving overall community health; and WHEREAS, words with double underlined type shall constitute additions to the original text and stFike through type shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. RECITALS. The foregoing recitals are hereby fully incorporated herein by this reference as legislative findings and the intent and purpose of the City Commission of the City of Casselberry. SECTION II. AMENDMENT OF SECTION 3-13.7 "DEVELOPMENT LANDSCAPE AND BUFFER REQUIREMENTS". Chapter III, Performance Criteria, Article XIII, Landscaping, Section 3-13.7. - Development landscape and buffer requirements, of the Unified Land Development Regulations of the City of Casselberry is hereby amended to read as follows: Section 3-13.7. Development landscape and buffer requirements. *** Sec. 3-13.7.C.1. — Bufferyard/screening. a. Purpose.
