WHEREAS, specifically, the City finds an amendment to Table 3-13.7.(C1) desirable to <br />include considerations, when needed due to site constraints, for minimum necessary encroachments <br />into landscape buffers for passive recreational uses, such as sidewalks or shared -use paths, only for <br />properties with Recreation and Open Space FLUM use designation and zoned ROS, subject to <br />approval procedures outlined in ULDR Article XVII, Site Plan Review; and <br />WHEREAS, the City also finds an amendment to ULDR 3-13.7.C.2.9, regarding <br />exceptions for accessways through landscape strips along the public right-of-way, should include <br />an exception for active transportation modes, such as sidewalks and shared -use paths, in addition <br />to vehicular traffic; and <br />WHEREAS, the City Commission of the City of Casselberry, Florida, hereby finds this <br />Ordinance to be in the best interest of the public health, safety, and welfare of the citizens of <br />Casselberry and the general public while promoting the goals, objectives, and policies in the City's <br />Comprehensive Plan related to enhanced multimodal mobility and improving overall community <br />health; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and stFike through type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. RECITALS. The foregoing recitals are hereby fully incorporated herein by <br />this reference as legislative findings and the intent and purpose of the City Commission of the City <br />of Casselberry. <br />SECTION II. AMENDMENT OF SECTION 3-13.7 "DEVELOPMENT <br />LANDSCAPE AND BUFFER REQUIREMENTS". Chapter III, Performance Criteria, Article <br />XIII, Landscaping, Section 3-13.7. - Development landscape and buffer requirements, of the <br />Unified Land Development Regulations of the City of Casselberry is hereby amended to read as <br />follows: <br />Section 3-13.7. Development landscape and buffer requirements. <br />*** <br />Sec. 3-13.7.C.1. — Bufferyard/screening. <br />a. Purpose. To provide standards that protect the health, safety, and welfare of <br />the public, improve the appearance of the community, preserve the natural <br />resources of the community, and ensure land use compatibility where <br />different types and/or intensities of land use activities abut another. <br />*** <br />Page 2 <br />Ordinance 23-1583 <br />
