Code Enforcement Hearing <br />Minutes, June 15, 2023 <br />Page 2 <br />Supervisor Acevedo advised that all events occurred within the corporate limits of the City. <br />The Officer's notes, case narratives, testimony, photographs, supporting documents and <br />PowerPoint presentation were all entered as part of the official record. <br />7. CE -22-000581: Subsequent Case at 1040 Seminola Boulevard Violations — City Code <br />3-10.3.b.1 Fence in disrepair, City Code3-10.3.c.1 Overgrowth, weeds, trash and debris. <br />Staff Presentation: Supervisor Acevedo advised that CE -22-000581, 1040 Seminola Boulevard <br />was not in compliance by the date previously set on April 20, 2023, by the Special Magistrate and <br />the fine should be imposed. <br />Discussion: Austen Palombizio, attorney and representative for the property owner came <br />forward and addressed the overgrowth violation. There was pushback from the property owner <br />whether they were in control of the property where the overgrowth was located. In reference to <br />the fence in disrepair, Mr. Palombizio presented photographs to the Special Magistrate and asked <br />for a 30 -day extension. Ms. Acevedo stated that she was not in favor of granting more time and <br />there is a lien reduction process that can be used. <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22- <br />000581, 1040 Seminola Boulevard based on Code Officer testimony, the Respondents did not <br />comply by the order imposed on April 20, 2023. It was ordered that the Respondents pay the City <br />of Casselberry a fine in the amount of $150 per day for each day the violation exists and each <br />day the violation continues to exist past the date of compliance of May 18, 2023. The burden shall <br />rest upon the respondents to immediately notify the Code Compliance officer. <br />8. CE -23-000064: Subsequent Case at 268 Frances Avenue Violations — City Code 1- <br />4.3.a No building permit, City Code 2-7.10.a Fence permit required, City Code 2- <br />7.10.c.7 One fence or wall per property line, City Code 2-7.16 Required garage or <br />carport, City Code 2-5.3.b Illegal land use. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000064, 268 Frances Avenue was <br />in compliance by the date previously set on May 18, 2023, by the Special Magistrate and the fine <br />should not be imposed. No further action was taken. <br />9. CE -23-000170: Subsequent Case at 905 SR 436 Violations — City Code 2-7.10.c.6 <br />non-compliant fences and walls. <br />Staff Presentation: Supervisor Acevedo advised that CE -23-000170, 905 SR 436 was in <br />compliance by the date previously set on May 18, 2023, by the Special Magistrate and the fine <br />should not be imposed. No further action was taken. <br />10. CE -23-000159: New Case at 1482 Canterbury Circle Violations — City Code 3- <br />10.3.c.5.c 1 & 2 Outdoor/openair storage- residential, City Code 3-10.9.f Unlicensed <br />and/or inoperable vehicle(s). <br />
