Code Enforcement Hearing <br />Minutes, May 18, 2023 <br />Page 3 <br />fence or wall per property line, City Code 2-7.16 Required garage or carport, City Code <br />2-5.3.b Illegal land use. <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on May 18, 2023. The City requested a correction date of June 15, <br />2023. If no compliance by June 15, 2023, then a fine of $100.00 per day should then be imposed <br />for each day of non-compliance thereafter. The City requests a subsequent hearing date of June <br />15, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to <br />speak for this case, a representative was present. <br />Discussion: Manny Godinez, contractor and representative for the property owner came forward <br />and addressed the Special Magistrate. Tina Gallium advised that the City has her under Tina <br />Klauzlowski and her legal name is Tina Gallium. <br />Special Magistrate Ruling: The Special Magistrate found that CE -23-000064, located at 268 <br />Frances Avenue was in violation of the City Code Sections as listed on the notice of code violation, <br />based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that <br />the respondent shall cure the violations by 1:00 P.M. June 15, 2023. If there is no compliance by <br />June 15, 2023, then a fine of $100.00 per day will be imposed for each day the property remains <br />in non-compliance. A subsequent hearing will be held on June 15, 2023, to determine if <br />compliance has been achieved. <br />12. CE -23-000170: New Case at 905 SR 436 Violations — City Code 2-7.10.c.6 non- <br />compliant fences and walls. <br />Staff Presentation: Officer Acevedo gave testimony that the property was reinspected and found <br />to remain in violation on May 18, 2023. The City requested a correction date of June 15, 2023. If <br />no compliance by June 15, 2023, then a fine of $150.00 per day should then be imposed for each <br />day of non-compliance thereafter. The City requests a subsequent hearing date of June 15, 2023, <br />to determine compliance. The Special Magistrate asked if there was anyone present to speak to <br />this case, a resident was present. <br />Discussion: Jayne Gunnoe, resident of the subdivision for over 40 years came forward and <br />addressed the Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -22-000170, located at 905 SR <br />436 was in violation of the City Code Sections as listed on the notice of code violation, based on <br />testimony and evidence provided by the Code Enforcement Officer. It was ordered that the <br />respondent shall cure the violations by 1:00 P.M. June 15, 2023. If there is no compliance by June <br />15, 2023, then a fine of $150.00 per day will be imposed for each day the property remains in <br />non-compliance. A subsequent hearing will be held on June 15, 2023, to determine if compliance <br />has been achieved. <br />13. CE -23-000191: New Case at 2288 Winslow Circle Violations — City Code 3-10.9.f <br />Unlicensed and/or inoperable vehicle(s). <br />Staff Presentation: Supervisor Acevedo advised that this case was in compliance and would <br />not be heard. No further action was taken. <br />
