Liability policy or separate business Auto Liability policy. <br />8. POLICY REQUIREMENTS. All of the insurance required under this section shall <br />be effected under enforceable polices issued by insurers licensed to do business in the State of <br />Florida, which policies must be acceptable to the City. All policies, except Worker's Compensation <br />policies, shall name City as additional insured, be in occurrence form, provide contractual liability <br />covering the liability assumed in the Agreement, and shall not exclude any activity that would <br />normally be associated with use of the Dedicated Areas without prior City consent. All policies shall <br />provide that they shall not be subject to cancellation or material change which affects the City except <br />upon at least 30 days' prior written notice to City at the address set forth in paragraph 19. <br />9. PROOF OF INSURANCE. Owner shall provide City the original policies, together <br />with satisfactory evidence of the payment of the premiums, prior to commencing construction, and <br />Owner shall maintain current policies on file with the City at all times during the Term. The name of <br />the project for which the Improvement(s) are to be installed and the type and amount of coverage <br />provided shall be clearly stated on the face of each policy. Not less than 30 days prior to expiration of <br />the term of such policies, the original of the renewal policy showing the renewal coverage shall be <br />delivered to the City. If Owner fails to furnish policies showing they are paid in full, City may obtain <br />the insurance, and the premiums on that insurance shall be paid to the City by Owner on demand. <br />Alternatively, City may cancel this Permit effective immediately. Owner shall require all contractors <br />and others engaged by the Owner to do work on the Dedicated Areas to carry such liability insurance <br />as may be commercially reasonable. All such policies shall name the City as additional insured. <br />Failure of Owner to maintain insurance coverage for itself or for any other persons or entities <br />for whom it is responsible or to ensure that its contractors and subcontractors maintain coverage <br />shall not relieve Owner of any contractual responsibility, obligation, or liability. <br />Use Agreement 2017 <br />395 Orange Lane — Keith McWilliams Page 5 of 12 <br />
