RESOLUTION 17-2937 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING A REVOCABLE PUBLIC RIGHT-OF-WAY UTILIZATION PERMIT AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND KEITH MCWILLIAMS, PROPERTY OWNER OF 395 ORANGE LANE (PARCEL NO. 08-21-30-520-0000-0090) FOR THE LAWFUL INSTALLATION AND MAINTENANCE OF DECORATIVE PAVERS WITHIN THE PUBLIC RIGHT-OF-WAY; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, Keith McWilliams ("Owner") desires the execution of a Revocable Right -of - Way Utilization Permit Agreement ("Agreement") authorizing the issuance of a City permit (the "Permit") from the City of Casselberry ("City"), whereby Owner will be allowed to install, construct, and maintain the following improvement(s): decorative concrete paver area described in Exhibits "A" and `B" of the Agreement attached hereto and incorporated herein by this reference (collectively, the "Dedicated Areas"), located between the edge of pavement and the property line at 395 Orange Lane (Parcel No. 08-21-30-520-0000-0090), more specifically described in Agreement; and WHEREAS, public rights-of-way are held by the City for the benefit of the general public, and it is the City's policy to preserve these public rights of way for that purpose; and WHEREAS, written authorization and lawful authority are required for any private use of public lands, and Owner has requested authorization from City to utilize and improve the right-of- way by installing and maintaining an 884 square foot area consisting of decorative concrete pavers and a concrete sidewalk for the Owner's benefit and for the benefit of the general public; and WHEREAS, the City requires that Owner be solely responsible for the fulfillment of certain commitments and covenants to assure the perpetual and continuous maintenance of any such improvement(s), which commitments and covenants are more particularly set forth herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves the Revocable Right -of -Way Utilization Permit Agreement with Keith McWilliams (attached as Attachment A), Owner of 395 Orange Lane, and authorizes the Mayor to execute said document on behalf of the City. SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. Resolution 17-2937 Pagel of 2
