RESOLUTION 23-3556 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A LOCAL AGENCY PROGRAM AGREEMENT WITH <br />THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR <br />THE CONSTRUCTION OF THE SOUTHCOT DRIVE BICYCLE / <br />PEDESTRIAN IMPROVEMENTS PROJECT; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is committed to making its community safer, more <br />comfortable, and more connected for people of all ages and abilities to walk and bike; and <br />WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City <br />identified the Southcot Drive Bicycle/Pedestrian Improvements project as part of its Capital <br />Improvement Program; and <br />WHEREAS, construction of the proposed improvements using federal funds was <br />programmed into the State of Florida Department of Transportation's (FDOT's) Work Program for <br />State Fiscal Year (FY) 2022-2023; and <br />WHEREAS, for FDOT purposes the project is also referred to as the "Southcot Drive <br />Sidewalk from Sunset Drive to Lake Triplett Drive" project; and <br />WHEREAS, design of the project has been completed using federal funds; and <br />WHEREAS, a Local Agency Program (LAP) Agreement with FDOT is necessary in order <br />to be able to construct the project with the assistance of federal funds; and <br />WHEREAS, FDOT has provided a proposed LAP Agreement for this purpose; and <br />WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable <br />to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Local <br />Agency Program Agreement with the State of Florida Department of Transportation for the <br />construction of the Southcot Drive Bicycle / Pedestrian Improvements Project and authorizes the <br />Mayor to execute said document, attached herewith, on behalf of the City. <br />SECTION LI. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
