RESOLUTION 23-3556 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION OF THE SOUTHCOT DRIVE BICYCLE / PEDESTRIAN IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry is committed to making its community safer, more comfortable, and more connected for people of all ages and abilities to walk and bike; and WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City identified the Southcot Drive Bicycle/Pedestrian Improvements project as part of its Capital Improvement Program; and WHEREAS, construction of the proposed improvements using federal funds was programmed into the State of Florida Department of Transportation's (FDOT's) Work Program for State Fiscal Year (FY) 2022-2023; and WHEREAS, for FDOT purposes the project is also referred to as the "Southcot Drive Sidewalk from Sunset Drive to Lake Triplett Drive" project; and WHEREAS, design of the project has been completed using federal funds; and WHEREAS, a Local Agency Program (LAP) Agreement with FDOT is necessary in order to be able to construct the project with the assistance of federal funds; and WHEREAS, FDOT has provided a proposed LAP Agreement for this purpose; and WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Local Agency Program Agreement with the State of Florida Department of Transportation for the construction of the Southcot Drive Bicycle / Pedestrian Improvements Project and authorizes the Mayor to execute said document, attached herewith, on behalf of the City. SECTION LI. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
