RESOLUTION 23-3346 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO DUKE ENERGY FLORIDA, LLC, A FLORIDA LIMITED LIABILITY COMPANY, OVER A PORTION OF THE NEW POLICE DEPARTMENT HEADQUARTERS, PARCEL IDS 20-21-30-300-OA1C-0000, 20-21-30-300-OA1B-0000, AND 20-21-30-300-OA1H-0000; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry has received a request from Duke Energy Florida, LLC, to provide an easement over a portion of the new Police Department Headquarters, parcel IDs 20-21-30-300-OA1C-0000, 20-21-30-300-OA1B-0000, and 20 -21 -30 -300 -OATH -0000, in order to cover electrical equipment installation associated with the new Police Department Complex; and WHEREAS, said easement is provided as Attachment A and provides for electric lines, supporting structures, and other appurtenant apparatus and equipment for the transmission and distribution of electrical energy; and WHEREAS, City staff has reviewed the easement and finds it acceptable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the conveyance of an easement to Duke Energy Florida, LLC, a Florida Limited Liability Company, over a portion of the new Police Department Headquarters, parcel IDs 20-21-30-300-OA1C-0000, 20-21-30-300-OA1B-0000, and 20-21-30-300-OA1H-0000, as provided in Attachment A, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
