RESOLUTION 23-3346 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING THE CONVEYANCE OF AN <br />EASEMENT TO DUKE ENERGY FLORIDA, LLC, A FLORIDA LIMITED <br />LIABILITY COMPANY, OVER A PORTION OF THE NEW POLICE <br />DEPARTMENT HEADQUARTERS, PARCEL IDS 20-21-30-300-OA1C-0000, <br />20-21-30-300-OA1B-0000, AND 20-21-30-300-OA1H-0000; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry has received a request from Duke Energy Florida, <br />LLC, to provide an easement over a portion of the new Police Department Headquarters, parcel IDs <br />20-21-30-300-OA1C-0000, 20-21-30-300-OA1B-0000, and 20 -21 -30 -300 -OATH -0000, in order to <br />cover electrical equipment installation associated with the new Police Department Complex; and <br />WHEREAS, said easement is provided as Attachment A and provides for electric lines, <br />supporting structures, and other appurtenant apparatus and equipment for the transmission and <br />distribution of electrical energy; and <br />WHEREAS, City staff has reviewed the easement and finds it acceptable to the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />conveyance of an easement to Duke Energy Florida, LLC, a Florida Limited Liability Company, <br />over a portion of the new Police Department Headquarters, parcel IDs 20-21-30-300-OA1C-0000, <br />20-21-30-300-OA1B-0000, and 20-21-30-300-OA1H-0000, as provided in Attachment A, and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
