RESOLUTION 23-3571 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT AGREEMENT WITH FRANK W. HYATT, EVELYN HYATT, AND VICTORIA HYATT ON PARCEL Ill: 34-21-30-525-0000-2720 (2331 ANTILLES DRIVE); PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City owns public utilities located on Parcel ID: 34-21-30-525-0000-2720 (2331 Antilles Drive) which are not currently within an approved utility easement; and WHEREAS, the property owner, Frank W. Hyatt, Evelyn Hyatt, and Victoria Hyatt, has agreed to grant a utility easement over a portion of the property for the necessary construction, installation, operation, maintenance, and repair of public utilities; and WHEREAS, Public Works & Utilities Department staff has reviewed the Utility Easement Agreement with Frank W. Hyatt, Evelyn Hyatt, and Victoria Hyatt and finds it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Utility Easement Agreement with Frank W. Hyatt, Evelyn Hyatt, and Victoria Hyatt on Parcel ID: 34-21- 30-525-0000-2720 (2331 Antilles Drive), attached hereto, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
