RESOLUTION 23-3572 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING <br />THE EXECUTION OF AMENDMENT NO. 1 TO THE <br />AGREEMENT WITH THE FLORIDA DEPARTMENT OF <br />ENVIRONMENTAL PROTECTION TO ASSIST WITH FUNDING <br />A PORTION OF UTILITY -RELATED IMPROVEMENTS FOR <br />THE LAKE KATHRYN CIRCLE UTILITY AND ROADWAY <br />IMPROVEMENT PROJECT (ALSO KNOWN AS PROJECT PW <br />1805 LAKE KATHRYN CIRCLE COMPLETE STREET <br />IMPROVEMENTS) TO EXTEND AGREEMENT AND TASK <br />DEADLINES; PROVIDING FOR CONFLICTS, SEVERABILITY <br />AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry's adopted Multimodal Transportation <br />Master Plan includes programming of the Lake Kathryn Circle Complete Street <br />Improvements project to improve pedestrian connectivity and safety; and <br />WHEREAS, as part of this project, the City wishes to simultaneously construct <br />various water and sewer utility improvements, the latter of which present an opportunity <br />to add lakefront homes to the City's sanitary sewer system, thereby potentially reducing <br />pollutant loads to the lake and downstream waterbodies due to septic tanks; and <br />WHEREAS, in August 2020 the City of Casselberry applied to the Florida <br />Department of Environmental Protection (FDEP) to consider providing funding <br />assistance for utility -related improvements associated with the project; and <br />WHEREAS, FDEP informed the City that it was awarded grant funding and <br />provided the City an Agreement to execute the project under the terms of the grant; and <br />WHEREAS, via Resolution 21-3227 the City Commission approved the final <br />version of the aforesaid Agreement; and <br />WHEREAS, completion of the project has taken longer than anticipated; and <br />WHEREAS, City staff requested a time extension for the grant, and FDEP has <br />provided a proposed Amendment No. 1 to the aforesaid Agreement in order to extend the <br />Date of Expiration of the Agreement to December 31, 2023 and the Task End Dates of <br />the Agreement to September 30, 2023; and <br />WHEREAS, City staff has reviewed the aforementioned Amendment No. 1 and <br />finds it acceptable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
