RESOLUTION 23-5363 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH BRYANT MILLER OLIVE FOR A STREET LIGHTING ASSESSMENT UPDATE UP TO AN AMOUNT NOT TO EXCEED $50,000; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry's Street Lighting Assessment Program is in need of an update in order to consider ongoing street lighting costs and future needs; and WHEREAS, the City previously used Bryant Miller Olive as outside counsel to complete an update to the program in 2014; and WHEREAS, time is of the essence in order to consider potential updates to the program that would go into effect in Fiscal Year 2024; and WHEREAS, City staff recommends authorization for the City Manager to execute an Agreement with Bryant Miller Olive after negotiations are completed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION L The City Commission of the City of Casselberry hereby approves and authorizes the City Manager to execute an agreement on behalf of the City with Bryant Miller Olive up to an amount not to exceed $50,000 to complete a Street Lighting Assessment update. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
