RESOLUTION 13-2509 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND SEMINOLE COUNTY FOR EMERGENCY INTERCONNECT WATER SERVICES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, in July 2008, the City contracted with CPH Engineers, Inc. to conduct an analysis that would identify areas in close proximity of the City's water distribution system that would be feasible to establish a potable water interconnection with local municipalities in the case of an emergency; and WHEREAS, the analysis identified certain locations near the water distribution systems in Seminole County and the cities of Maitland and Winter Springs as Ivey areas for potable water interconnection; and WHEREAS, the City has since established potable water interconnections with the cities of Winter Springs and Maitland and now wishes to establish a potable water interconnection with Seminole County; and WHEREAS, Public Works staff from the City of Casselberry and Seminole County have developed an interlocal agreement in an effort to devise a mechanism to provide potable water supply to each other in the case of an emergency; and WHEREAS, the interlocal agreement provides a methodology for potable water interconnection, payment processing, repair and maintenance, and other necessary understandings in order to ensure that the highest level of water quality is available to service all customers in the case of an emergency; and WHEREAS, the agreement is for a term of 25 years, beginning after the date of execution; and WHEREAS, City staff have reviewed the Interlocal Agreement for Emergency Interconnect Water Services between the City of Casselberry and Seminole County and finds it sufficient to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Interlocal Agreement for Emergency Interconnect Water Services between the City of Casselberry and Seminole County and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
