Code Enforcement Hearing Minutes, April 20, 2023 Page 3 Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22- 000902, 1420 Guinevere Drive based on Code Officer testimony, the Respondents did not comply by the order imposed on February 16, 2023. It was ordered that the Respondents pay the City of Casselberry a fine in the amount of $150 per day for each day the violation exists and each day the violation continues to exist past the date of compliance of April 17, 2023. The burden shall rest upon the respondents to immediately notify the Code Compliance officer. 11. CE -22-000567 New Case at 1131 Castle Wood Terrace Violations — City Code 1- 4.3.a: No Building Permit, City Code 3-10.3.a.4 Roofs, gutters, down spouts — maintenance, City Code 3-10.3.c.1: Overgrowth, weeds, trash and debris, Standard Unsafe Building Abatement Code (SUBAC) Unsafe Building - Section 1-4.6 Staff Presentation: Officer Andreone gave testimony that the property was reinspected and found to remain in violation on April 18, 2023. The City requested a correction date of May 18, 2023. If no compliance by May 18, 2023, then a fine of $250.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of May 18, 2023, to determine compliance. Randy Lamb, Building official gave testimony for this case. Christina Diaz, Seminole County Fire Marshall gave testimony for this case. The Special Magistrate asked if there was anyone present to speak to this case, the property owner was present. Discussion: Jay Caliber, contractor and representative for the property owner came forward and addressed the Special Magistrate. Special Magistrate Ruling: The Special Magistrate found that CE -22-000567, located at 1131 Castle Wood Terrace was in violation of the City Code Sections as listed on the notice of code violation, based on testimony and evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violations by 1:00 P.M. May 18, 2023. If there is no compliance by May 18, 2023, then a fine of $250.00 per day will be imposed for each day the property remains in non-compliance. A subsequent hearing will be held on May 18, 2023, to determine if compliance has been achieved. 12. CE -22-000581: New Case at 1040 Seminola Boulevard Violations — City Code 3- 10.3.b.1 Fence in disrepair, City Code3-10.3.c.1 Overgrowth, weeds, trash and debris. Staff Presentation: Officer Acevedo gave testimony that the property was reinspected and found to remain in violation on April 18, 2023. The City requested a correction date of May 18, 2023. If no compliance by May 18, 2023, then a fine of $100.00 per day should then be imposed for each day of non-compliance thereafter. The City requests a subsequent hearing date of May 18, 2023, to determine compliance. The Special Magistrate asked if there was anyone present to speak to this case, a representative was present.
