Code Enforcement Hearing <br />Minutes, April 20, 2023 <br />Page 3 <br />Special Magistrate Ruling: A ruling was made by the Special Magistrate that case CE -22- <br />000902, 1420 Guinevere Drive based on Code Officer testimony, the Respondents did not comply <br />by the order imposed on February 16, 2023. It was ordered that the Respondents pay the City of <br />Casselberry a fine in the amount of $150 per day for each day the violation exists and each day <br />the violation continues to exist past the date of compliance of April 17, 2023. The burden shall <br />rest upon the respondents to immediately notify the Code Compliance officer. <br />11. CE -22-000567 New Case at 1131 Castle Wood Terrace Violations — City Code 1- <br />4.3.a: No Building Permit, City Code 3-10.3.a.4 Roofs, gutters, down spouts — <br />maintenance, City Code 3-10.3.c.1: Overgrowth, weeds, trash and debris, Standard <br />Unsafe Building Abatement Code (SUBAC) Unsafe Building - Section 1-4.6 <br />Staff Presentation: Officer Andreone gave testimony that the property was reinspected and <br />found to remain in violation on April 18, 2023. The City requested a correction date of May 18, <br />2023. If no compliance by May 18, 2023, then a fine of $250.00 per day should then be imposed <br />for each day of non-compliance thereafter. The City requests a subsequent hearing date of May <br />18, 2023, to determine compliance. <br />Randy Lamb, Building official gave testimony for this case. Christina Diaz, Seminole County Fire <br />Marshall gave testimony for this case. The Special Magistrate asked if there was anyone present <br />to speak to this case, the property owner was present. <br />Discussion: Jay Caliber, contractor and representative for the property owner came forward and <br />addressed the Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -22-000567, located at 1131 <br />Castle Wood Terrace was in violation of the City Code Sections as listed on the notice of code <br />violation, based on testimony and evidence provided by the Code Enforcement Officer. It was <br />ordered that the respondent shall cure the violations by 1:00 P.M. May 18, 2023. If there is no <br />compliance by May 18, 2023, then a fine of $250.00 per day will be imposed for each day the <br />property remains in non-compliance. A subsequent hearing will be held on May 18, 2023, to <br />determine if compliance has been achieved. <br />12. CE -22-000581: New Case at 1040 Seminola Boulevard Violations — City Code 3- <br />10.3.b.1 Fence in disrepair, City Code3-10.3.c.1 Overgrowth, weeds, trash and debris. <br />Staff Presentation: Officer Acevedo gave testimony that the property was reinspected and found <br />to remain in violation on April 18, 2023. The City requested a correction date of May 18, 2023. If <br />no compliance by May 18, 2023, then a fine of $100.00 per day should then be imposed for each <br />day of non-compliance thereafter. The City requests a subsequent hearing date of May 18, 2023, <br />to determine compliance. The Special Magistrate asked if there was anyone present to speak to <br />this case, a representative was present. <br />Discussion: Austen Palombizio, attorney and representative for the property owner came <br />forward and addressed the Special Magistrate. <br />Special Magistrate Ruling: The Special Magistrate found that CE -22-000581, located at 1040 <br />Seminola Blvd was in violation of the City Code Sections as listed on the notice of code violation, <br />
